Welcome to the Privacy Policy of PLC Academy (“licensor," "we," "us," or "our"). 1.0 INTERNATIONAL USERS
- The platform is hosted and administered in the Mexico and is governed by Mexican legislation. Any personal information you submit will be sent to us in Mexico and will be stored on servers located in the Mexico. You agree to have your personal information sent to the Mexico in order to get services on the PLC Animator: PLC Simulator.
- If you are visiting a website from outside the Mexico, please be aware that Mexican law may not provide the same level of privacy protection as the law in your region.
2.0 INFORMATION COLLECTED
- You agree that when you download, install, use, access, or otherwise engage with the application or website, we may use automated techniques to gather information about your Device and about you and your use of the application and the Services.
- You may also be needed to supply some information about yourself in order to download, install, or use the application or certain of its features or capabilities, and the application may allow other users to share relevant data about yourself and about others.
- Our Privacy Policy applies to all information we collect via or in connection with our Applications and Websites. By downloading, installing, using, or giving information to or through our Applications and/or Websites, you indicate that you have received, read, and understood the terms of our Privacy Policy, and that you accept and consent to all actions done by us in accordance with the Privacy Policy.
- Licensor’s use of your personal information shall be governed by this Privacy Policy. By using the Licensed Application, you indicate your understanding and acceptance of the Privacy Policy.

- We collect personal and other information from you when you provide information to us or whenever you interact with us via the app and/or services. The following below are some of the ways Licensor collect information when you use the PLC Animator App:

- Information Provided through Communication: The app provides links or forms that can be used to contact us so you can comment, make a complaint, make suggestions and ask questions. Licensor may store information from email on file, but does not currently sell or license this information with third parties without express authorization from you.

5.0 LEGAL BASIS FOR DATA PROCESSING
- The legal basis we utilize is determined by the objective of the processing of personal data, which may be one of the following:
- Contract - pursuant to Article 6 (1) GDPR, in circumstances where we are required to process certain data in order to execute a contract, such as when a user agrees the EULA to use the program;
- Consent – in cases where a user chooses to send us data relating to the Privacy Statement, Marketing Statement, Antispam Statement, Supplemental Statement, Statement regarding Data Processing for PLC Academy Managed Protection, Statement regarding Data Processing for Web Control (previously known as Statement regarding Data Processing for Parental Control), Statement regarding Data Processing for Call Filter, Protection of Community, etc.
- Legal duty - pursuant to Article 6 (1) GDPR, in circumstances where we are required to handle data to satisfy legal requirements, such as for tax purposes;
- Legitimate interest - pursuant to point (f) of Article 6 (1) GDPR, in circumstances where we have legitimate interests as a cybersecurity firm unless such interests are exceeded by the user's interests or basic rights and freedoms. In such circumstances, for example, when personal data is kept in our infrastructure and assessed for recent and possible cyber threats using artificial intelligence and/or depending on our professionals' experience. Recital 49 of the GDPR recognizes that it is a company's legitimate interest to treat personal data to the extent required and appropriate to guarantee network and information security.

- We retain your personal data for as long as reasonably necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, or for other legitimate business purposes, such as maintaining business and financial records, resolving disputes, maintaining security, detecting and preventing fraud and abuse, and enforcing our agreements. After the applicable retention period has elapsed, your personal data will be anonymized and deleted.

11.0 CHILDREN'S PRIVACY
- Protecting the privacy of children is of utmost importance to us. In this section, we address our compliance with children's privacy laws and restrictions on app usage by minors.
11.1 Compliance with Laws
- Age Restrictions: The App is intended for use by individuals who are [13/16/18] years of age or older, depending on the jurisdiction. We do not knowingly collect personal information from children under the applicable age limit without parental consent.

12.0 ACCOUNT CLOSURE / ERASURE
- If you choose to terminate your PLC Animator account, your personal, non-public data will usually be removed from public view on our Services within 30 business days.
- Exceptional cases:
- We will maintain your personal information even after you delete your membership account if it is fairly in compliance with our legal responsibilities (including law enforcement requests), comply with regulations, settle disputes, ensure security, hinder fraud and illegal activities, or accomplish your request.
- You acknowledge that information shared with others via the platform messaging, updates, or group posts will remain accessible after you delete your account or remove content from your own profile or inbox, and we have no control over the information that other users have replicated out of our platform.
- The ratings or review information connected with closed accounts will be an unknown individual.
13.0 TERMINATION / SUSPENSION OF ACCOUNT
- You agree that we may for legitimate reasons, in our sole discretion, and without your prior consent your consent, terminate your account.
- Grounds for such termination may include:
- extended periods of inactivity,
- violation of this User Agreement,
- fraudulent, harassing, or abusive behavior,
- suspected illegal activities or investigated reports,
- behavior that is harmful to other users, third parties, and the community ethos of our Application or our business interests.
- In the event that we terminate your account, you may not register for the Application again without our express permission.
- If you believe that any action has been taken against your account in error, please contact us at [email protected].
- In addition, if we believe, in our sole discretion, that a violation of this User Agreement or suspected illegal activities or investigated reports has occurred, we may take any other corrective action we deem appropriate.
- We reserve the right to investigate suspected violations of this User Agreement or illegal and inappropriate behavior by your or other users' reports via the Application because the Licensor has zero knowledge about encrypted chat messages.
- Licensor will cooperate with local law enforcement investigation or court order requesting or directing us to disclose the identity, behavior, or activities of anyone believed to have violated this User Agreement or to have engaged in illegal behavior. Licensee may request termination of your account at any time and for any reason.
- Any suspension or termination of your account shall not affect your obligations to Licensor under this User Agreement (including but not limited to ownership, indemnification, any representations and warranties made by you, and limitation of liability), which by their sense and context are intended to survive such suspension or termination.
14.0 FAIR INFORMATION PRACTICES
- The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.
- In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur, we will notify you via email and in-app notification within 7 business days.
- We also agree to the Individual Redress Principle which requires that individuals have the right to legally pursue enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individual have enforceable rights against data users, but also that individuals have here. - We collect your email address in order to send information, respond to inquiries, and/or other requests or questions.
